IS IT WORTH IT, AND WHAT ARE THE ODDS OF WINNING?

The applicant appealing the AAT’s decision must persuade the Judge hearing the appeal that the AAT committed an error of law that played a role in the outcome of the case.

Legal mistakes could consist of:

breach of procedural due process, or improper interpretation of a provision at issue in the proceeding.

An error of law need not prevent a judge from rejecting an appeal if the AAT reached an accurate finding based on

 the evidence presented.

 

A Judge reviewing an immigration case officer’s decision:

does study all relevant papers filed by the parties in the original case and does listen to legal arguments from both sides of the appeal; but, it does not take into account any new evidence or information that was not presented in the initial case (unless in extraordinary situations).
